The NUANS report is not required if you are registering a Business Name Registration, Sole Proprietorship, General Partnership, Partnership or Limited Partnership.

Legal Endings, What is the Difference?

There is no difference in the legal ending chosen for the name of the corporation. You will need to ensure you are happy with the legal ending as if you want to change it after you complete the NUANS report, you will need to order a new NUANS report with the changed legal ending.

Distinctive Terms For Incorporation, What is it? 

The distinctive term for your business is important as it helps the NUANS database view businesses within a similar industry. For example, if your business name was “ABC Restaurant Inc.” the distinctive element would be “ABC” and “Restaurant” would be descriptive.

When selecting a corporate name, it is highly recommended that you provide a name with a strong distinctive element. This will help your business to be identified quickly and easily with potential customers.

How Much Does the Instant NUANS Report Cost?

The instant NUANS report cost is $54.99 excluding taxation.

How Do I Receive the NUANS Report?

Once you have made payment for the Instant NUANS report, a download button will appear within 30 seconds for immediate results. Make sure you stay on this page until the download button appears.

How Long is the NUANS Report Valid?

Once you submit a new NUANS report, the report is valid for 90 days to use for incorporation or trademark purposes. If the 90 day timeframe has passed, you will need to complete a new NUANS report and you will have an additional 90 days to complete the incorporation or trademark documentation.

Can I Submit a Different Variation of the Name From the NUANS Report I Ordered?

The name on the NUANS Report and the name submitted for either Incorporation or Trademarking has to be exactly the same.

Does the Jurisdiction of the NUANS Report Matter?

Yes, the NUANS report jurisdiction matters and can only be used in the jurisdiction you are incorporating. A Trade Mark does not require a jurisdiction as it is assumed to be Canada. 

Can I File a Trademark With Ontario Business Central?

We can provide the NUANS report for you, but you will need to use a trademark agent specifically to complete the trademark application with the Federal government. A list is provided through the Government of Canada in the link above.

Who Owns NUANS?

The NUANS database is owned and operated by Industry Canada which is a government body. As part of Innovation, Science and Economic Development Canada. The word NUANS (Newly Upgraded Automated Name Search) is a protected trademark, however there are many companies using the word NUANS in the name and URL of their business in an attempt to be confused with the Federal government. 

Is NUANS Necessary?

Yes, if you wish to be incorporated in any of the jurisdictions listed above, the NUANS report is mandatory to complete an incorporation. The NUANS report is also required if completing a Federal (Canada) Incorporation or applying for a Trademark. 

Do I Need a NUANS Report For a Sole Proprietorship?

No, the NUANS report is not mandatory unless you are incorporating a business within specific jurisdictions. It is highly recommended that you search the business name you would like to use to see if there are existing businesses already operating with that business name. We highly recommend at minimum you complete a preliminary search on the proposed business name. The fee is inexpensive and our team reviews and searches the NUANS database for any potential business name conflicts and sends you the results. Alternatively, you can complete the Instant Preliminary Search where you can search by yourself to see if there are conflicts to your proposed business name.
